This website is run by Alumic Systems, Inc. ("Alumic", "we", "us"), based in Los Angeles, California. By using it you agree to these terms. If you do not agree, please do not use the site. Our privacy policy explains how we handle personal information, and our cookie notice what the site stores in your browser.
Using the site
You may read the site, use the free tools and contact us, for your own business or personal purposes. The site is provided for general information about our services and the trades we work with. We may change, suspend or remove any part of it at any time, and we do not promise it will always be available or free of errors.
Articles, guides and examples on the site are general information written for trade contractors as a group. They are not tailored to your business. Where we give a worked example with numbers, the numbers are illustrative unless we say where they came from.
Client engagements
These terms cover the website only. If you become a client, the services we provide, the fees, deliverables, confidentiality and each party's responsibilities are set out in a separate written agreement signed by both of us. If that agreement conflicts with these terms, the agreement governs the engagement. Nothing on this site is an offer to provide services on particular terms until that agreement is signed.
The free tools are estimates, not advice
The calculators, checklists and message builders under /tools run in your browser on the numbers and answers you give them. Their results are:
- informational estimates. They are only as good as what you enter, and they rely on simplifying assumptions that each tool describes on its page;
- not financial, accounting, legal or tax advice. Before you make a pricing, spending, hiring or legal decision, check it with a qualified professional who knows your business;
- not a forecast. A figure described as "at stake" is what could be affected under the assumptions shown, not money you have lost or will earn.
Review-request messages and similar text the tools produce are drafts for you to check. You are responsible for what you send and for following the rules of any platform you use, including review platforms' rules on asking customers for reviews, and the law on messaging customers.
No guarantee of results
Search rankings, advertising results, call volumes and bookings depend on things no one controls, including search engines, ad platforms, competitors, your market and how your business handles the enquiries it gets. Nothing on this site is a promise of any particular ranking, number of leads, revenue or return, and you should not rely on it as one.
Intellectual property
The site's text, design, graphics, logo, tools and code belong to Alumic Systems, Inc. or its licensors and are protected by copyright, trademark and other laws. You may view and print pages, and share links to them, for your own non-commercial use. You may not copy, republish, sell or build a competing product from the site or its tools without our written permission. Short quotations with a link back to the page are welcome.
What you type into a tool stays yours. If you send us feedback or suggestions, we may use them without owing you anything.
Acceptable use
When using the site, you agree not to:
- break any law, or use the site to infringe anyone's rights;
- send spam, false information or someone else's details through the contact form;
- try to get into parts of the site or our systems you are not authorised to use, including the staff console;
- probe, scan or test the site's security, or interfere with its operation, for example by overloading it;
- scrape or harvest the site by automated means beyond ordinary search-engine indexing, or get around our rate limits;
- upload or transmit malicious code.
If you believe you have found a security problem, please tell us at hello@alumic.agency rather than testing it further.
Third-party links
The site links to other websites, such as sources we cite and platforms we write about. We do not control them and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
Disclaimers
The site, its content and its tools are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We work to keep the site accurate and current, but we do not warrant that it is complete, correct, secure or uninterrupted.
Limitation of liability
To the fullest extent the law allows, Alumic Systems, Inc. and its owners and staff will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of, or inability to use, the site or its tools, even if we were told such damages were possible.
Because the site and tools are free, our total liability to you for any claim arising from them is limited to one hundred US dollars ($100). Some places do not allow some of these limits; where that is the case, they apply only as far as the law permits. This section does not apply to work under a client agreement, which has its own terms.
Indemnity
If you break these terms or the law in using the site, and someone makes a claim against us because of it, you agree to defend and indemnify Alumic Systems, Inc. and its owners and staff against that claim, including reasonable legal fees.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from them or from your use of the site will be heard only in the state or federal courts located in Los Angeles County, California, and you and we both consent to those courts' jurisdiction. Before starting a formal dispute, please email us so we can try to resolve it directly.
Changes to these terms
We may update these terms. When we do, we will change the effective date at the top of this page. The version in effect when you use the site is the one that applies; if you keep using the site after a change, you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term straight away, we have not waived it. These terms, with the privacy policy and cookie notice, are the whole agreement between you and us about the website; a client agreement governs any services.
